CHILD ABUSE IN THE CLASSROOM: A LEGAL CHALLENGE TO ESSA

 

On September 20, 2017 there will be a national press release and 2 live Press Conferences (Texas, Indiana) to formally announce a national campaign to repeal the Every Student Succeeds Act (ESSA passed Dec. 2015) and restore the Family Educational Rights and Privacy Act (FERPA). Currently we have 21 state coordinators and our hope is before long to have all 50 states and DC on board.  We are prepared to take legal action if necessary. 

 

FERPA passed in 1974 is a federal law that governs access of educational information and records including personally identifiable information (PII).  Protections under FERPA were gutted in 2011 by the Obama administration by changing regulation and therefore bypassing Congress.

 

We were told the ESSA would end Common Core and return control of education to the state and local government. ESSA does neither.  It does not end Common Core and it does not return control of education to the states or local districts.  It does, however, codify into federal law the assessment and remediation of your children’s behaviors, attitudes, values, beliefs and dispositions (social and emotional learning – SEL).  It also codifies into law college and career ready national education standards.  The only standards that meet those criteria are standards aligned with Common Core. 

 

Cash strapped states have invested billions in the implementation of Common Core aligned standards, assessments, curriculum, computer programs and equipment, books, teacher training and infrastructure enhancements and unless the federal government is willing to pay for states to convert to other standards no state can afford to get out of their current standards which are all aligned with Common Core. Common Core was implemented in such a way that reversing it would be next to impossible.  The ACT-SAT-GED and the international test PISA are all now aligned with Common Core.  So selling ESSA saying it is the end of Common Core is deceptive just like it was deceptive when they told us Common Core was internationally benchmarked and created by the states.  ESSA is illegal and it violates our Constitution.  This is now a battle that must be taken to the federal level.  We intend to do everything in our power to have ESSA repealed and FERPA restored.  If you would like to join us please register at www.childabuseintheclassroom.com
