DHS Announces Major Change to U.S. Asylum Policy

Before the New Year, the Department of Homeland Security (DHS) announced a new asylum policy aimed at confronting the growing illegal immigration crisis in the United States. Effective immediately, the United States will begin the process of invoking Section 235(b)(2)(C) of the Immigration and Nationality Act. Under the Migration Protection Protocols (MPP), individuals arriving in or entering the United States from Mexico—illegally or without proper documentation—may be returned to Mexico for the duration of their immigration proceedings.

Florida State Courts Don’t Have Jurisdiction To Determine Detainer Constitutionality

On December 27, 2018, a Florida appellate court reversed a state trial court’s decision that held Miami-Dade County’s policy of holding illegal aliens on immigration detainers for Immigration and Customs Enforcement (ICE) was unconstitutional. Although the Third District Court of Appeals’ (DCA) opinion in Junior v. LaCroix did not rule on whether the detainer policy is constitutional, the case is still highly encouraging and may have implications far beyond the Sunshine State.
